the marriage or civil partnership is ongoing and both parties still intend to live with each other permanently; and
the couple remain able to maintain and accommodate themselves and any dependants without recourse to public funds; andthe spouse or civil partner can demonstrate sufficient knowledge of English language and life in the UK, unless s/he is exempt from this requirement.
