Gera , would you please give your 3-5 points of what exactly should be included in Tort reform in people's opinion- specifically, please. I am gathering information on it for tomorrow's discussion at our County Medical Society. They have professional lobbyists and they will give us their perspective, too.
It should be interesting.

i think tort reform solution is very simple -
medical courts.. have a panel of 3 specially trained judges decide cases on merit.

Gera, none of those "principles" address the core of the problem - the fact that 12 ignorant jurors decide cases not on basis of merit, but on how sorry they feel for the poor victim.
They just don't know enough to decide the case on merit, this is why we don't have jurors in bankruptcy courts, just the judges.
We need to have medical courts structures similar to that..

i browsed through it...will read in full later. Some assumptions are questionable..
And it does not address medical education aspect at all. And it's a huge piece, since now medical trainees are taught to "rule out everything, test for everything". And this is just a cookbook medicine... the whole culture of this system must be changed.

Gera, i saw that they propose an arbitration system, which is probably not an optimal solution.. arbitration is never binding, while a court decision is. AFAIK people who are not happy with their arbitration decision always have an option to file a court claim. I don't think you can take away a right so sue someone ( and make them arbitrate )

Julia, the culture of the system can ONLY change AFTER the liability issue is fixed.. It's not in scope of the tort reform to change how doctors think..

I wonder if those medical courts (which is a good idea) would be constitutional...do we have anything simliar in any other industry?
